If you are an employee and you are looking for a solicitor to advise in relation to a settlement agreement bringing your employment to an end then please get in touch with us to talk things through.

Employees in the UK have a variety of rights under employment law, including the right to receive the national minimum wage, protection from unfair dismissal, protection against discrimination, and the right to paid holidays and parental leave. They are also entitled to a safe working environment and the right to join a trade union.

To be eligible for statutory redundancy pay in the UK, you need to have worked for your employer for at least two continuous years. The amount of redundancy pay you are entitled to depends on your age, length of service, and weekly earnings (up to a maximum amount).

If an employee believes they have been unfairly dismissed, they can make a claim to an Employment Tribunal. The claim must usually be made within three months from the date of dismissal. Before going to an Employment Tribunal, employees are generally required to go through an early conciliation process with Acas (the Advisory, Conciliation, and Arbitration Service).

Employee: Someone who has a contract of employment and is entitled to full employee rights (e.g., sick pay, holiday pay).

Worker: A broader category that includes employees but also people who work under a contract that is not employment but still entitles them to some employment rights (e.g., minimum wage, holiday entitlement).

Self-employed: A person who works for themselves and runs their own business. They do not have the same rights as employees or workers, like holiday pay or sick pay.

Employees are entitled to maternity leave, which is up to 52 weeks (26 weeks of ordinary maternity leave and 26 weeks of additional maternity leave). Statutory Maternity Pay (SMP) may be paid for up to 39 weeks. Fathers or partners are entitled to paternity leave, typically 1 or 2 weeks, and may also qualify for statutory paternity pay.
