Power of attorney Faqs

A Power of Attorney is a caring arrangement where you can appoint a trusted person (known as an “attorney”) to make important decisions on your behalf. This includes managing your finances and health, especially if you become unable to do so yourself due to illness, injury, or mental incapacity.

There are two main types:

  • Property and Financial Affairs: This type allows your chosen attorney to manage your finances.
  • Health and Welfare: This type enables your attorney to make decisions about your healthcare and well-being on your behalf.

It’s important to choose someone you trust wholeheartedly, someone who truly understands your wishes and has the capability to manage both your finances and healthcare needs with care and diligence.

Depending on the document, a Power of Attorney can either take effect immediately or only when you lose mental capacity, which is usually confirmed by a medical professional.

To cancel a Power of Attorney, you’ll need to create a new document that clearly states your intention to revoke the previous one. This new document may need to be registered with the relevant authority.
